Understanding the client-lawyer relationship will make you a better consumer and will also help to preempt potential conflict.
Although my law practice is devoted to personal injury, the topic of client-lawyer relations is applicable to all areas of practice.
The basics are as follows:
1. The client-lawyer relationship is contractual;
2. The relationship is also personal;
3. The client is the decision maker;
4. The lawyer is the advisor; and,
5. Communication is the key to a successful relationship.
Contractual Relationship
Your attorney will memorialize his responsibilities and his fees in a written agreement. The agreement will also spell out conditions for terminating the client-attorney relationship should that be necessary.
It is good practice to review each provision of the agreement with the attorney to assure you understand and agree to its terms.
The initial draft of the agreement is dynamic and its terms are negotiable, so discuss any concerns you may have as to any of its terms.
Personal Relationship
Personality plays an important part in the attorney selection process. The ability to work well with an attorney depends on his willingness to listen, discuss, and explain.
